Battling CPS can be a nightmare. The federal Children’s Bureau has amended their Child Welfare Policy Manual so that it now allows individual states to apply for title IV-E funding reimbursement. The rate of reimbursement is 50% for services provided by attorneys representing families in any kind of foster care related legal proceedings. So any time CPS removes your kids, or tries to remove your kids, you could be eligible!

Beforehand, only the state title IV-E agency’s (MDHHS in Michigan) attorney costs were eligible for reimbursement. Yup, that’s right, before now only CPS could claim that money! But now it’s available for families fighting CPS as well! States are now allowed to claim title IV-E funding to cover the cost of attorney’s fees on behalf of parents and caregivers whose children have been placed in foster care.
Even the Supreme Court is encouraging state courts to apply for the funding!
Once the announcement was made, the Supreme Court made a public announcement, encouraging family courts all over the country to take whatever steps are necessary to apply for the funding. And if the goal of Michigan’s family court system is to keep families together and make sure that children stay in loving and secure homes and out of foster care, then this funding will make a huge difference!
